Amongst the other things happening yesterday, the ECJ ruled that the UK’s capacity market for electricity generation is illegal state aid and must stop. The capacity market was a way of using market forces to ensure adequate electricity supply to meet winter peaks. It may not be perfect but it was one of the few attempts at government working with the electricity industry on long-term planning in society’s interests.

I certainly don’t pretend to understand all the legal issues in play but I think probably the ECJ are right that this is state aid, and right that EU rules don’t allow it (with subtleties about what the Commission have to do give permission, which I think actually is possible).

It’s a reminder that the EU is far from perfect from a left wing perspective. It has a tendency to legislate and to do so in ways that favour free market approaches and to the detriment of socialist approaches. If there were a better alternative, there would surely be a principled left wing case for Brexit.
