Private purchases, goods damaged in transit

I know I've lost this one, but I bought a screen for my motorbike privately online. It arrived with damage. The seller claims it was fine when he packed it and that either I've damaged it or it was done in transit. Either way, he's not interested.

Just wanted to moan to someone really. What do you think?

Does no one have recourse to claim off the couriers, if that is where damage occurred?

Yeah, the seller does. He said he'll give me the tracking number and I can if I want.

The packaging was fine. If it was damaged in transit (and I'm not convinced) then it's been through rubbing because of the way he'd packed it.

When you say 'privately online' do you mean via one of the various sites (e.g. eBay, Gumtree)? If not, how was it advertised?

You may have recourse under the Consumer Contract Regulations.

It was in the classifieds on a motorbike forum. I've reported it to the forum owner but I don't think they've got any sway either.

Personally, I'd write pointing out that the goods were received in a damaged state and therefore not fit for purpose/as described. Ask for the goods to be collected and a refund issued, and remind him that it is for him to claim against the couriers if required.

Depending on the value, there's always the small claims route: Money Claim Online if he doesn't pay up.

Thanks. I've done all that, and he's not interested. It's only £45 so it's not worth arsing about with threats of court.

I'm just a bit upset to be honest. I've sold loads this way over the years (mainly through CC) and if there was ever an issue I took it on good faith and sorted it out. This is the first time I've come across a slippery nobber.

Have you exposed him on the forum? I have bought a few things from forums, but only from people with a reputation to lose. That check doesn't work (for future buyers) if his history isn't made visible.

I shouldn't get involved in these things. Sometimes I think I let myself be a walkover, but then when I say something it escalates and I wish I hadn't started because there's no chance of resolution...
